AQUEA LAUNCH OFFER: TERMS & CONDITIONS

1. Promoter: This offer is run by AQUEA P/L (ABN 98 552 291 934).

2. Eligibility: Open to Australian pool builders (ABN holders) only. Offer is valid for residential pool projects only; commercial projects are not eligible. One (1) application per applicant.

3. How to Apply: Eligible builders must complete the online application form and provide accurate contact details and information about a proposed upcoming pool build.

4. Application Period: Applications close at 5:00pm (AEDT) on 30 October 2026.  Late or incomplete applications may not be considered.

5. Selection: Up to ten (10) applicants will be selected. Selection is based on the information provided and is not a game of chance. All selections are made at AQUEA’s sole discretion. Selection may consider factors including build timing, project suitability, location, visibility, and alignment with AQUEA product use. AQUEA may contact applicants to request additional information during the selection process. AQUEA may withdraw the skimmer offer prior to shipment if the project is delayed, cancelled, or materially changed.

6. Notification: Successful applicants will be notified by email and/or phone by 6 November 2026.  Not all applicants will be contacted.

7. What Is Provided: Each successful applicant will receive:

• one (1) AQUEA pool skimmer supplied free of charge.
• CONC or FG models only
• standard colours only

The skimmer is supplied as product only and does not include installation, labour, freight (unless agreed otherwise), or any other costs.

8. Conditions of Use: By accepting a skimmer, successful applicants agree that:

• Installation and use of the skimmer is their responsibility.
• The skimmer will be used in the project outlined in the application (unless otherwise agreed).
• The skimmer must not be resold.
• The skimmer is supplied subject to AQUEA’s standard product warranty terms.
• The applicant is responsible for removal and reinstallation costs associated with warranty claims.
• To the extent permitted by law, AQUEA is not liable for loss, damage, or injury arising from installation, use, or misuse of the skimmer.

9. Trial Product / Existing Agreements: The skimmer is provided as a trial and evaluation product only. Applicants are responsible for ensuring their participation does not breach any existing supply, exclusivity, or other commercial agreements.

10. Indemnity: The applicant warrants that they hold current public liability insurance appropriate for pool construction works. The applicant indemnifies AQUEA against any claims arising from site access, installation, or use of the skimmer.

11. Marketing & Site Access: Successful applicants agree that AQUEA may use images or footage of the selected build for sales and marketing purposes. Applicants agree to provide AQUEA with reasonable site access during construction and once complete for photography or video. Where AQUEA cannot attend in person, applicants will provide reasonable progress updates, images, or footage. Applicants are responsible for obtaining all necessary consents from property owners for site access, photography, and marketing use.

12. Privacy: Information collected will be used to administer this offer and for related business and marketing purposes, in line with AQUEA’s Privacy Policy.

13. General: Submitting an application does not guarantee selection. AQUEA may amend, suspend, or cancel this offer where reasonably required.  Nothing in these Terms limits rights under the Australian Consumer Law.
